      We command you, that you summon Isabel Nicholson, Emily Nicholson, Mary Nicholson, and John Kinney, if they shall be found in your county, personally to be and appear before the County Court of said Vermilion County on the first day of June Term thereof, to be holden at the Court House in Danville in said Vermilion County on the Third Monday of June 1873 to answer unto the Petition of Thomas Pratt administrator of the estate of Andson Nicholson deceased, on the return day hereof; which said petition was filed in our said Court on the 17th day of May AD 1873, and prays that this Court will order and direct the sale of real estate of said deceased for the payment of debts.

      To the Honorable R.W. Hanford, Judge of said court:
      Your petitioner Thomas Pratt administrator of the estate of Andson Nicholson deceased respectfully shows unto your honor that the personal property belonging to said decedent at the time of his death amounted to the sum of Three Hundred and eighty-four dollars and twenty two cents according to the appraisement made in pursuance of law, all of which said personal estate came into the hands of Isaac N. Payton the former administrator, and was by said Isaac N. Payton paid out to Isabel Nicholson widow of said Andson Nicholson, as part payment of the sum of Five Hundred and fifty-nine Dollars and fifty cents awarded to her by said appraisers as her specific allowance.
      And your petitioner further shows unto your honor that there yet remains unpaid of said specific allowance the sum of ninety-three Dollars and seventy-three cents, and that claims have been allowed against said estate to the amount of Nine Hundred and forty-six Dollars and thirty-nine cents, and that the probable costs of administration will amount to the sum of Two Hundred Dollars, and that your petitioner knows of no claims yet to be presented against said estate.
      And your petitioner further shows unto your honor that none of the personal property belonging to said estate has ever come to the hands of your petitioner.
      And your petitioner further shows unto your honor that said Andson Nicholson at the time of his death was seized in fee simple of the following described pieces or parcels of land lying and being in the County of Vermilion and State of Illinois viz:
      The South East quarter of section thirty four township nineteen north range eleven west, except twenty eight acres off of the north end of the west half of said quarter section
      Also ten acres described as follows, to wit: beginning at the north west corner of lot two of the west half of the north east quarter of section three township eighteen north range eleven west then east eighty poles thence south 42 degrees west without any variation thirty five poles thence west fifty three poles and eighteen links thence north twenty four poles to the beginning
      Lot two in block three in McRoberts and Walker's addition to the town now city of Danville
      And your petitioner further shows that said Andson Nicholson left him surviving his widow Isabel Nicholson, and Emily Nicholson and Mary Nicholson his children and only heirs at law both of whom are minors.
      And your petitioner further shows that one John Kinney is in possession of said premises as tenant.
      Your petitioner therefore prays your honor for an order for the sale of said premises above described as for so much thereof as may be necessary to pay the claims now unpaid against said estate, and also for the appointment of commissioners to set off the dower of said Isabel Nicholson therein.
      And your petitioner further prays that said Isabel Nicholson and John Kinney may be made parties defendants hereto, and that a summons may issue returnable etc and that your honor will grant such other orders as may be right and just

      Know all men by these presents, that we, George F. Coburn, Thomas Pratt, and Thomas N. Chenoweth of the County of Vermilion and State of Illinois, are held and firmly bound unto the People of the State of Illinois, for the use of Emily Nicholson and Mary Nicholson in the penal sum of Six Thousand Dollars, current money of the United States, which payment, well and truly to be made and performed, we, and each of us, do hereby bind ourselves, our heirs, executors and administrators and assigns, jointly, severally and firmly by these presents.
      Witness our hands and seals this 19th day of June AD 1873
      The condition of this obligation is such, that if the above bounden George F. Coburn who has been appointed Guardian of Emily Nicholson and Mary Nicholson shall faithfully discharge the office and trust of such Guardian according to law, and shall make a true inventory of all the real and personal estate of the ward that shall come to his possession or knowledge, and return the same unto the County Court of Vermilion County, at the time required by law, and manage and dispose of all such estate, according to law, and for the best interest of said ward, and faithfully discharge his trust in relation thereto, and to the custody, nurture and education of said ward and render an account, on oath, of the property in his hands, including the proceeds of all real estate that may be sold by him, if any, and of the management and disposition of all such estate, within one year after his appointment, and at such other time as shall be required by law or directed by the Court; and upon removal from office, or at the expiration of his trust, settle his accounts in said Court, or with the wards or their legal representatives, and pay over and deliver all the estate, title papers and effects remaining in his hands, or due form him such settlement, to the person or persons lawfully entitled thereto, then this obligation shall be void; otherwise to remain in full force and virtue

      And now again comes said petitioner by JB Mann his attorney and come also Greenville H. Graves, Joseph Stewart and Reason H. McMillan commissioners heretofore appointed by the court to assign dower of Isabel Nicholson in the lands in said petitioner described, and present to the court under their hands and seals their report in writing in the words and figures following viz:

      It is therefore ordered adjudged and decreed by the court that said petitioner as administrator as aforesaid proceed to sell said real estate in said petition and the above report described at public auction at the south door of the building occupied by the clerk of this court, in Danville Illinois, after having advertised the time, place and terms of said sale, for at least four weeks, by posting up notice containing the same together with a description of said premises in at least four public places in said Vermilion County, and also by publishing a like notice in some newspaper of general circulation in said county, four successive weeks prior to said sale. That said sale be made upon the terms of ten per cent cash in hand and the balances in six and twelve months, the purchaser to give note bearing ten percent interest with good personal security, and mortgage on the premises sold. And that said petitioner execute to the purchaser at said sale proper deeds of conveyance for said premises, and that he report his action in the premises to the court without delay. And that this case is continued

    Complaint against administrator - failure to settle estate 
    • George Coburn filed a complaint against administrator Thomas Pratt, on July 17, 1877, for Pratt's failure to settle the estate of Andson Nicholson. Mr. Coburn was the guardian of Andson's daughters, Emily and Mary. The court posted notice for Mr. Pratt to appear before the next term of court to settle the estate.

      Whereas, complaint has been made to the County Court of said County on the part of ..Coburn by Evans Wallow his attorneys, that Thomas Pratt administrator de bonis non of the estate of Andson Nicholson deceased has failed to settle the estate of said decedent in accordance with law.
      You are, therefore, hereby commanded that you cite and give notice to the said Thomas Pratt administrator de bonis non as aforesaid, that he be and appear before the County Court of Vermilion County, at a ____ term thereof, to be holden at the Court House, in Danville, on the Third Monday of August AD 1877, then and there to settle his accounts with the said estate and distribute the moneys remaining in his hands to the persons entitled thereto and further to do and perform what shall then, by the said Court, be required and adjudged. And hereof make due service and return as the law directs.

    • It appears Isabelle and her daughters appealed the court's order approving Thomas Pratt's final report. The record did not show if and how the court ruled on Isabelle's objections to that final report. Thus, the parties asked the court to make clear its ruling, and if overruling Isabelle's objections, to forward the amended record to the circuit court.

      Now it is hereby agreed by the parties hereto that in case the judge of said court is of the opinion that said objections of said Isabella Martin to said final account of said administrator wee overruled by the court and that said Isabella Martin joined in the appeal from said order of said court overruling said objections and approving said final account, then in that case the record in said proceeding may be so amended by .... whosing said state of facts and that a correct transcript of said amended record be at once sent up to the circuit court of said county

      Trusting in your fidelity, therefore, the said Court does by these presents consistute and appoint you to be Guardian unto said Minors and authorize and empower you to take and have the care of their persons and the custody and management of their property, frugally and without waste of destruciton, to improve and account for the same in all things according to law.

Collins ten acres of land belonging to said heirs adjoining the farm of said Collins for the period of one year from the first of September AD 1879 in consideration of which the said Collins promiss to pay the said Lindsey the sum of Twelve dollars on or befoe the first day of June AD 1880.
      And said Collins agrees to surrender said premisis to said Lindsey at the expiration of this lease in as good condition as they now ... the natural wear and tear only excepted.
