      This Indenture made and entered into this 4th day of September in the year of our Lord one thousand Eight hundred and seventeen Between William Berry of the county of Garrard and state of Kentucky of the one part and Nathan Douglass of the same county and state of the other part witnesseth that the said Berry for and in consideration of the sum of nine hundred and four dollars and Seventy five cents to him in hand paid the receipt whereof he does hereby acknowledge hath bargained granted sold aliened and conveyed and by these presents doth grant bargain sell alien and convey to the said Nathan Douglass his heirs and assigns forever a certain tract or parcel of land lying and being in the county of Garrard and state of Kentucky and bounded as follows, to wit containing by survey seventy eight and three fourth acres. Beginning at a black ash tree standing in Harods preemption line corner to Yantz’s and Moberly and thence with Harrods line now Yants N 9 E 148 poles to a stake near a white oak now ? in said Yantzs field thence n 51 ½ E 75 ½ poles to a stake near a black ash corner to Harm Lapsley line thence with his line S 38, E 95 ½ poles to an elm and haw bush corner to Graham on Harms line thence S 50 ½ W 185 ½ poles to the Beginning. To have and to hold the said tract or parcel of land with its appertenunces to him the said Nathan Douglass his heirs assigns Executors administrators forever. And I do hereby obligate and bind myself my heirs and assigns my administrators and executors forever by these presents firmly and severally to warrant and defend the title to said premises against the claim of myself my heirs and against the claim or claims of all and every other person.     Purchased 65 acres of land from Christopher Hopwood  
    • On October 4, 1831, Nathan Douglass purchased 65 acres of land in Garrard County from Christopher Hopwood. On this same date, Mr. Hopwood executed a title bond, obligating himseld and his heirs to make a good title to land on or before October 4, 1833. Mr. Hopwood died without conveying title.

      On April 28, 1835, Fielding Lewis, administrator of Christopher Hopwood, acknowledged receipt of $85, from Nathan, in full discharge of note for said land.

      A survey of this land was made in April of 1835, and showed that this land was on the waters of Dicks River, adjacent to Harmans patent line, Bates corner, and running alongside the Crab Orchard Road; 65 1/2 acres in all.

      Nathan filed suit in Garrard County Circuit Court, in 1837, to compel the Hopwood heirs to make good title to the tract of land. The suit notes that Christopher Hopwood and his family had moved to Indiana.

      At the September term of court, 1839, the Court ordered the heirs to convey land by deed to Nathan Douglass.

      Papers show that on October 4, 1831, Christopher Hopwood sold Nathan Douglass 65 acres of land in Garrard County. This same date, C. Hopwood executes a title bond, obligating Hopwood/heirs to make a good title to land on or before October 4, 1833.
      C. Hopwood died without conveying title.
      On April 28, 1835, Fielding Lewis, administrator of Christopher Hopwood, acknowledged receipt of $85, in full discharge of note for said land.
      Survey of land, made April 23, 1835, shows this is the land adjacent to Harmans patent line, Bates corner, and running alongside the Crab Orchard Road; 65 1/2 acres in all.
      Nathan filed a bill in the Garrard Circuit Court, in 1837, requesting a court decree compelling C. Hopwood's heirs to make a title for the land.
      Depositions taken of S. Anderson (witness for Fielding Lewis' receipt) and RD Lusk (looks to be Nathan's attorney)
      Guardian ad litum for 5 of the Hopwood heirs (the ones under 21), filed an answer in September of 1839 - does not contest the action - agrees that title should be executed and conveyed to Nathan.
      Court decree, September term 1839; ordered the heirs of C. Hopwood to convey land by deed to Nathan Douglass.
      **Note - the heirs fail to make title; thereafter, in June of 1840, Alexander McKee, appointed as commissioner, Conveys land by deed to Nathan.
