Settlement also notes that John Q Adams the husband of Angelina Adams was present during the settlement – Thomas Johnson & wife had notice of the time and place of the settlement, the other heirs reside out of Garrard Cty

    Brother Peyton's Death 
    • Prior to his death, Peyton made a verbal disposition of his property. After his death, Peyton's verbal statements were reduced to writing, and four witnesses produced the writing purporting to be Peyton's noncupative will to the Thomas County court on April 25, 1854.
      In that purported will, Peyton "willed and desired to give Nacky Simpson of the State of Kentucky, all his interest in the Estate in Kentucky, recently left by his deceased father. To be paid and turned over to the said Nackey Simpson by his Executor when the said Nackey Simpson shall arrive at the age of Twenty one years of shall be united in marriage."
      Little Nackey was Peyton's niece, the daughter of Malinda Walden Simpson.
      Stephen Sampson filed suit, contesting the admission to probate of Peyton's purported noncupative will. The court case went all the way to the Georgia Supreme Court. The Court rendered its decision during the May Term, 1857. Citation: Sampson v. Browning, 22 Ga. 293 (Ga. 1857).
      The jury in the lower court proceedings found that the will should be sustained and given effect, except for the real estate conveyances. Stephen Sampson appealed. The Georgia Supreme Court reversed the judgment, holding that executor John C. Browning, as propounder of the will, failed to satisfy the necessary statutory requirements for proving and giving effect to a noncupative will; specifically, the Court found Mr. Browning failed to produce evidence that Peyton, at the time of pronouncing the words propounded as his will, "did bid the persons present, or some of them, bear witness that such was his last will, or to that effect."
      Practically speaking, the Supreme Court of Georgia struck down the will. Effectively, it is as if Peyton died without a will.
      Under general legal principles, with no will, Peyton's property would be distributed through intestate succession to his legal heirs. Peyton apparently had no wife or children, who would stand to inherit his property. Consequently, as Peyton's parents were both dead, his property would then go to, and be divided equally among his siblings, which is what occurred.
      Stephen Sampson, as Peyton's brother-in-law, stood not only to gain his wife Elizabeth's share, but also the shares of Permelia Walden and Malinda Walden Johnson, by virtue of the following agreements made in July of 1854.

      (in settlement records of John Walden's estate, dated 1858, see note that John's estate was to be divided into 9 shares - being his 9 children, but that there were only 8 heirs. Peyton's share was divided equally among his brothers and sisters. This receipt is acknowledging receipt of Elizabeth's 1/8 part of $969.52 - the amount that was going to Peyton Walden by the will of John Walden.
